ARTICLE 9 – (1) In requests for tourism investment certificates;
a) After reviewing the submitted applications, a demand review report (Annex-3) is prepared for the facilities found to be suitable.

1) Certificates are issued to facilities deemed appropriate for documentation via an Official Approval or a Decision of the Evaluation Board.
2) The status of facilities deemed unsuitable for certification shall be notified to the applicant with a reasoned letter.
Evaluation of requests for direct tourism business certificates as well
ARTICLE 10 – (1) In requests for direct tourism enterprise certificates;
a) After examining the submitted applications, a demand review report (Annex-4) is prepared for the facilities found to be suitable.
b) As a result of the examination conducted; facilities whose applications are deemed appropriate shall be subject to inspection, and the status of facilities whose applications are not deemed appropriate shall be notified to the applicant with a reasoned letter.
c) As a result of the inspection;
1) Certificates shall be issued to facilities deemed appropriate for certification by an Official Approval or a Decision of the Evaluation Board.
2) The audit report result or the Decision of the Evaluation Board regarding facilities deemed unsuitable for certification shall be notified to the applicant with reasons.
3) In the event that only a deficiency in documentation is identified following the inspection, a period of 30 days is granted for the submission of the document in question. If the requested document is not submitted, the request shall be deemed rejected.
4) If a difference is detected in the requested facility type or class, the entrepreneur's request regarding this matter shall be sought. Otherwise, the request shall be rejected. This situation also applies to tourism-certified facilities. In allocated facilities, however, the type and class are determined without seeking a request.
5) For facilities whose requests are not approved following two consecutive inspections conducted under the same entrepreneur's name within one year, a third application may be made provided that six months have passed from the date the most recent inspection result was notified. The date of the first inspection shall be taken as the basis for the calculation of the one-year period.
Evaluation of requests to convert tourism investment certificates into tourism business certificates or partial tourism business certificates, and the determination of whether facilities with investment certificates have commenced operations
ARTICLE 11 – (1) In requests for a tourism enterprise certificate and a partial tourism enterprise certificate;
a) After being examined and deemed appropriate, a request review report is prepared (Annex-4) and they are included in the facility inspection program.
b) In the event that the submitted “Business Opening and Operating License” is not deemed appropriate, the applicant shall be requested to remedy the deficiency within a period of 30 days from the date of notification. If the appropriate document is not submitted within the given period, the license shall be canceled in accordance with the provisions of subparagraph (d) of the 1st paragraph of Article 34 of Law No. 2634.
c) As a result of the inspection, certificates are issued to facilities whose requests are deemed appropriate via Authority Approval or Evaluation Board Decision.
c) Following the inspection, actions shall be carried out regarding facilities whose requests are deemed inappropriate, in accordance with the inspection report or the Decision of the Evaluation Board.
d) Regarding facilities with investment certificates that are determined to have opened for business without applying to convert to a tourism enterprise or partial tourism enterprise certificate; a business opening and operating license is requested, they are included in the inspection program for a final status determination, and procedures are carried out in accordance with subparagraphs (c) and (ç) of paragraph 1 of this article.
Evaluation of requests to convert the short-term tourism business certificate into a long-term tourism business certificate
ARTICLE 12 – (1) In requests for partial tourism operation certificates;
a) Application is made with a petition and a facility introduction report. For those deemed appropriate upon examination, a demand inspection report (Annex-4) is prepared.
b) As a result of the examination conducted;
1) Certificates are issued to facilities deemed suitable for certification via Authority Approval or the Decision of the Evaluation Board.
2) The status of facilities deemed unsuitable for certification shall be notified to the applicant with a reasoned letter.
Boundary works
ARTICLE 13 – (1) As a result of the evaluations to be conducted by the Classification Commission; in the event that the facility fails to exceed the minimum score threshold determined for its own type, an inspection report shall be prepared, and since the facility will have lost the qualities essential for certification during its operating period, its certificate shall be canceled in accordance with the provisions of subparagraph (e) of paragraph 1 of Article 34 of Law No. 2634.
(2) As a result of the classification form application conducted, the score received by the facility determines its class, if any, within its category. In businesses that exceed the score threshold set for a higher class; the quantitative and qualitative requirements necessitated by the new class are not sought. However, a restaurant requirement is sought in 4 and 5-star hotels.
The decisions of the Classification Commission regarding the upgrading, downgrading, or the determination that there is no benefit in operating with a certificate shall be finalized with the Authority's Approval to be obtained. No Authority's Approval shall be obtained for facilities whose class does not change. Following the finalization of the classifications performed, the results shall be notified to the certificate holder.
(4) In cases where document renewal is required as a result of the classification form application; a new classification request regarding the facility shall not be processed before the certification process is completed.
(5) A new classification request regarding a facility that has been classified three times within one year may be made 6 months after the date of the last classification communiqué. The date of the first classification shall be taken as the basis for the calculation of one year.
(6) In classification studies; swimming pools shall not be scored for units whose investment is ongoing, or for those that do not meet the qualities specified in the second paragraph of Article 31 of the Regulation within the accommodation facility. These unscored pools are named "Type B".
(7) All units currently operating within the facility are evaluated and scored once. The fact that a facility previously had deficiencies due to being a certificate holder and/or a change in capacity does not prevent a classification study from being conducted. Regarding these findings, it is recommended that an audit report be separately prepared and processed.
(8) Except for cases where a document from any institution and/or a business opening and operating license or a document regarding its validity is required, any deficiencies and irregularities identified during the application of the classification form shall not prevent the processing of the classification form and the issuance of a new document.
(9) Application capacity is taken into account in classification studies.
(10) In cases where the inspection and/or classification form application cannot be carried out at the facility; the reason why the inspection and/or classification cannot be performed shall be specified in detail in the report to be issued.
